    By using this website and placing orders through it, the user agrees to the following:

    • Use the website solely for the purpose of viewing products and placing orders.
    • Do not place any fraudulent or false orders. If an order is reasonably considered to be fraudulent, HSPORTWEAR is authorized to cancel it and inform the relevant authorities.
    • Have legal capacity to enter into contracts (the user declares to be over 18 years of age).
    • Provide your contact information in a truthful and accurate manner in order to be able to send orders.

    PERSONAL DATA PROTECTION

    HSPORTWEAR informs users of this website about its policy regarding the processing and protection of personal data that may be collected when browsing or contracting services through the privacy policy. You can access the privacy policy from the website at any time.

    PURCHASE CONDITIONS

    Service availability. Users have the possibility of placing orders for the items offered through the website for delivery to an address within Spain or to a European destination.

    PRODUCT AVAILABILITY

    Orders are subject to product availability. If there are any difficulties in supplying the products or if there are no items in stock, HSPORTWEAR will inform the customer of this circumstance, either by email or telephone, and will refund any amount paid for the unavailable product(s) or exchange the product for another of the same value, as decided by the customer.

    PRODUCT PRICES

    The prices of the items include all applicable taxes but do not include shipping costs, which will be added to the total amount. HSPORTWEAR reserves the right to modify prices at any time, although the products will be invoiced based on the price in force at the time of placing the order (subject to product availability).

    The purchase order will indicate both the total price of the product(s), including VAT and the corresponding shipping costs, as indicated in the following sections.

    The applicable VAT rate will be the one legally in force at any given time depending on the specific item in question.

    For orders destined for the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT pursuant to the provisions of Article 21 of Law 37/1992, without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of these territories.

    • Standard Shipping 3-5 business days, no shipping charges will apply.
    • Express shipping from 1 to 2 business days, shipping costs amount to €9.90, this amount must be added to the total amount .
    • For in-store pickup orders, no shipping charges will apply.
    * For orders belonging to Club items, the shipping cost is calculated once the order has been completed.

      Zone 2 : Spain (Balearic Islands)

      • For orders under €100, shipping costs are €18.75, which must be added to the total amount. Shipping costs will therefore be borne by the customer.
      • For orders equal to or greater than €100, shipping costs will not apply.

        • Standard Shipping 7-8 business days, no shipping charges will apply.
        • Express shipping from 4 to 6 working days, shipping costs amount to €9.90, this amount must be added to the total amount . Shipping costs will therefore be borne by the customer.

        For REST OF EUROPE * consult conditions by email.

        * The customer will be responsible for the cost of postage, which may vary depending on the value of the order and the place to which it must be sent, taking into account a possible surcharge for delivery to a remote area.

        Zone 5: United Kingdom.

        • Air shipping 3-4 business days, no shipping charges will apply.

        Zone 6: United States.

        • Air shipping 3-4 business days, no shipping charges will apply.

        DUTY

        Any possible customs duties, taxes and other charges (for international shipments and those to the Canary Islands, Ceuta or Melilla) are not included in the item price or shipping costs. These charges are the buyer's responsibility*.

        If the buyer refuses to pay these charges and requests a return of the order, HSPORTWEAR will refund its value less the cost of shipping and subsequent return.

        HOW TO PLACE AN ORDER

        To place an order you must select the desired item or items. Once you have selected all the items you want, they will be added to your shopping basket. The next step is to process the order and make the payment. To do this you must follow the steps requested on the website and follow the purchase instructions that appear on the screen. You will only be asked for the data necessary for the purchase and subsequent delivery of the order. Before formalizing the purchase you must EXPRESSLY ACCEPT these conditions, as well as the privacy policy .

        The data recorded by the website constitute proof of the transactions carried out. The customer will receive confirmation of the order via email.

        During the process, before making the payment, you can modify the details of your order. The order is not formalized until the process is completed, which will occur when you have made the payment. Clicking on “Pay” implies that you purchase and pay for the selected items; this step constitutes a binding commitment.

        There are no purchase limits. Users can place orders for any number of items, with no minimum or maximum amounts set.

        PURCHASE OF PRODUCTS BY EMAIL, TELEPHONE OR IN WRITING

        In the case of orders for products by e-mail, telephone or in writing, HSPORTWEAR will immediately inform you of receipt of the order. This confirmation does not constitute acceptance of the offer unless HSPORTWEAR explicitly states this in writing.

        To make a purchase you must provide your name, email, phone number, address, etc. It is essential that all data is correct. We are not responsible if you do not receive your products due to an incorrect address.

        RIGHT TO CANCELLATE THE ORDER

        HSPORTWEAR reserves the right to reject an order from a customer with whom there is a dispute.

        Likewise, HSPORTWEAR has the right to reject or cancel an order for justified reasons, such as:

        • Due to an error in the billing data (which is incorrect or impossible to verify).
        • If there is suspicion of bank card fraud.
        • If it is not possible to send it to the indicated address.
        • If there are reasons to suspect that the user is not an end consumer.
        • If the user is under 18 years of age.
        • If full payment has not been made.
        • There was an obvious error in the price offered.
        • The product is not available / in stock.

        Likewise, HSPORTWEAR reserves the right to cancel mass orders placed using automated techniques (bots or scripts) that restrict the ability of other users to access our offers and products.

        CHECKING DATA

        When you send us your order we may carry out certain checks on it before proceeding to process it. These checks may include verifying your address, creditworthiness and checking for possible fraud. Regarding the latter: we carry out partially automated checks on all purchases to filter out unusual or suspicious transactions or transactions that can be identified as susceptible to fraud. Suspected fraud on www.hsportwear.com will be investigated and, if necessary, legal action taken against them.

        HSPORTWEAR may reject an order – for example, after determining the solvency of a customer, or the legal and effective viability of the specific offer, in particular, any possible infringement of third party rights.

        PURCHASE OF PERSONALIZED PRODUCTS

        Customized products are those that have been individualized by the client based on the patterns available at HSPORTWEAR, so that they are made according to the client's concept, for example in the design, colors as well as the incorporation of logos.

        HSPORTWEAR sends the customer a quote by e-mail, stating the general terms and conditions of delivery and payment methods (payment must be 100% in order to be able to deliver/collect). The customer has the quote and the conditions for verification and can send HSPORTWEAR a written or e-mail confirmation within 30 days of receipt. The contract is concluded upon receipt of the order confirmation by the customer. The customer will then receive a brief confirmation from HSPORTWEAR by e-mail.

        Until the final version of the customization design is received (with the approval of the HSPORTWEAR design team) and confirmation of payment (indicated in the quote), the maximum given delivery period for the products will not begin to run.

        Once the production of any custom sportswear order has been completed in the factory, in order to pick it up in store or send it to its destination, it must be paid in full 100%.

        METHOD OF PAYMENT

        You can use a bank card or bank transfer as a means of payment. In the case of payment by card, the total amount of the order, including the applicable shipping costs, will be charged to the customer's account at the time of purchase.

        Payments are only accepted in EUROS.

        When paying by card, if any incident occurs during the process (for example, the terminal informs you that the card has been denied), the order will be automatically cancelled.

        By clicking on “Pay” the user confirms payment for the order and that the bank card is his/hers. To minimize the risk of unauthorized access, the data on your bank card will be encrypted. Credit cards will be subject to verification and authorization by the issuing entity, but if the entity does not authorize payment, the order will be automatically cancelled, and the system will inform the customer of this cancellation.

        HSPORTWEAR also offers you the possibility of making payment by bank transfer. If you pay by bank transfer, we will start processing the shipment (or manufacturing in the case of personalized products) once we have received your payment. This may take several days. If we have not received any payment within 12 calendar days after shipping your order, your purchase will be automatically cancelled.

        Please transfer only the exact amount specified in your order confirmation and make individual transfers per order, using the unique reference number stated in your order confirmation.

        We will not accept any payment method other than that included in these terms of sale. Please do not attempt to make a payment using any method other than those specified. If you do so, we will not be liable for any loss of payment or any other damages that may arise as a result of this action.

        The order will be sent to the address you provide once the total amount of the order has been confirmed. If the amount is not the total, HSPORTWEAR reserves the right not to send the order until the customer has paid in full.

        DELIVERY

        The products will be sent to the address indicated by the user.

        Delivery times range from 1 to 5 business days for addresses on the peninsula and up to 7 business days for deliveries to the Balearic Islands, Canary Islands, Ceuta and Melilla.

        Delivery time for addresses outside of Spain ranges between 4 and 9 business days.

        The indicated deadlines will be respected provided there are no unforeseen or extraordinary circumstances beyond our control.
        Unforeseen or extraordinary circumstances include, but are not limited to, natural disasters, labor disputes, serious supply chain issues, government actions, and any other event beyond HSPORTWEAR's reasonable control that affects the ability to meet delivery times.

        If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option of continuing with the purchase by setting a new delivery date or cancelling the order with a full refund of the price paid.

        For the purposes of these conditions, it will be understood that “delivery” has occurred or that the order has been “delivered” at the moment in which you or a third party indicated by you acquires physical possession of the products, which will be accredited by the signature of receipt of the order at the agreed delivery address.

        DELIVERY CONDITIONS FOR PERSONALIZED PRODUCTS

        The delivery time for personalized products is a maximum of 6 weeks from order confirmation (designs and payment confirmation). If an express delivery service is contracted, the delivery time will be agreed individually with the customer.

        For standard products in stock, the delivery time may vary depending on the shipping area from the time the order is placed and payment is confirmed.

        The delivery period will be extended, without the need for communication from HSPORTWEAR, if the customer has not fulfilled the payment obligation and the delivery of the final design (with acceptance by HSPORTWEAR).

        In order to deliver/collect any order for Personalized Sportswear, it must be 100% paid.

        RESERVATION OF OWNERSHIP

        The merchandise will remain the property of HSPORTWEAR until payment requirements have been met.

        The customer is obliged to treat the goods with care until the change of ownership occurs and they become his/her property.

        SENDING SAMPLES AND FILES

        Samples or sizes sent by HSPORTWEAR for quality and size testing must be handled with care. Samples must be returned before the date stated on the delivery note. An extension of this period is only possible with prior written agreement.

        Samples will be sent to the client after payment and verification of a deposit for an amount to be considered according to the value of the samples requested in writing.

        Shipping and collection costs for samples or sizes are the responsibility of the customer. Returns with insufficient postage will not be accepted.

        If the samples are not returned and received in the same condition as they were sent by HSPORTWEAR (without odours, stains, damage, etc.) within the period established in the delivery note, an invoice will be issued for them according to the standard price of each garment according to the HSPORTWEAR price list in force at the time of shipment. The value of the deposit will be retained as part of the payment for the samples.

        HSPORTWEAR reserves the right of ownership and copyright for the illustrations, designs, drawings, calculations and other files delivered to the client.

        IMPOSSIBILITY OF DELIVERY

        If it is not possible to deliver the order to the address indicated, HSPORTWEAR will try to deliver it to a third party indicated by the customer or attempt to deliver it again at a later date. To do so, please contact HSPORTWEAR if you are not going to be at the address to arrange delivery on another day.

        If within 15 days from the date your order is available for delivery, the order has not been delivered for reasons not attributable to HSPORTWEAR, we will understand that you wish to withdraw from the contract and we will consider it terminated.

        As a consequence of the termination of the contract, we will return all payments received from the user, including delivery costs, without any undue delay and, in any case, within a maximum period of 14 days from the date on which we consider the contract terminated. Please note that transport resulting from the termination may have an additional cost, so HSPORTWEAR will be authorized to pass on the corresponding costs to you.

        RIGHT OF WITHDRAWAL

        The user has the right to cancel an order without giving any explanation. This right is the right of withdrawal established by art. 102 of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

        The withdrawal period will expire 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the goods.

        To exercise the right of withdrawal, you must notify H SPORT WEAR, SLU, Parque Industrial PISA C/ Diseño 15, Mairena del Aljarafe, 41927, Sevilla or by email at info@hsportwear.com, of your decision to withdraw from the contract through an unequivocal statement.         Withdrawal and returns policy for personalized products:

        In accordance with the provisions of the General Law for the Defense of Consumers and Users (Royal Legislative Decree 1/2007), we inform our customers that the right of withdrawal will not apply in the following cases:

        1. Custom Products : Due to the nature of the products we offer, which are designed and made to customer specifications, returns and exchanges are not accepted. This includes, but is not limited to, custom-made products, items with personalized names or designs, or products made to specific order.

        1. Exceptions : In the event that the product has manufacturing defects or does not conform to the agreed characteristics, the customer will have the right to request a repair, replacement or refund. In such case, the customer must contact us within a maximum of 14 days from receipt of the order, providing the necessary documentation and evidence (photographs of the defect, etc.).

        1. Shipping costs : In the event that a return is required due to a product defect, we will assume the shipping costs associated with the return and replacement.

        Please note that since these are fully customized products, we cannot accept returns for reasons other than quality or compliance with agreed requirements.

        Withdrawal and returns policy for non-personalized products

        In accordance with the provisions of the General Law for the Defense of Consumers and Users (Royal Legislative Decree 1/2007), customers of our store have the right to withdraw from their purchase within a period of 14 calendar days from receipt of the product, without the need for justification. Below we detail our withdrawal policy:

        1. Right of withdrawal: If the customer wishes to exercise his right of withdrawal, he may return the purchased product provided that:
        The product is in perfect condition, without having been used beyond merely checking its nature, characteristics and/or operation.
        It must be returned in its original packaging, along with all accessories, manuals and documentation that it included.

        1. Withdrawal period: The withdrawal period will expire 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the goods. To exercise this right, you must contact us at info@hsportwear.com and indicate your intention to withdraw from the purchase.

        1. Refund: Once the goods have been received and their condition verified, we will proceed to make a full refund of the price paid for the product, including standard shipping costs. The refund will be made using the same payment method, unless the customer has expressly provided otherwise, within a maximum period of 14 days from receipt of the returned product.

        1. Return costs: The customer must assume the direct costs of returning the product, unless otherwise indicated or the return is due to an error or defect in the product.

        1. Exceptions: Returns will not be accepted for products that do not meet the conditions mentioned above or that are excluded by current legislation (for example, products that by their nature cannot be returned for hygiene or health-related reasons, if they have been unsealed).

        Consequences of withdrawal:

        In the event of withdrawal from this contract, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us) without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will make such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any costs as a result of the reimbursement.

        We may withhold reimbursement until we have received the goods back or you have supplied evidence of the return of the goods, whichever is the earliest.

        You must return or deliver the goods to us directly without undue delay and, in any event, no later than 14 calendar days from the date on which you notify us of your decision to withdraw from the contract. The deadline will be deemed to have been met if you return the goods before the deadline has expired.

        You will only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

        WARRANTY

        The warranty is based on legal provisions.

        Commercially and technically unavoidable tolerances in colour, quality, material, weight and other finishes are not grounds for complaint by the customer.

        In textile printing, slight variations in tone, both in colour proofs as well as in subsequent delivery, are always possible and unavoidable. HSPORTWEAR makes every effort to reproduce the colours in the catalogue (online or in brochures) and on its website as realistically as possible. In particular, the colours that can be seen on the HSPORTWEAR website depend on the customer's screen settings, so HSPORTWEAR cannot guarantee an accurate colour comparison. For this reason, the delivery of the HSPORTWEAR colour palette on fabric is highly recommended.

        Control drawings for authorization to production and color printing must be thoroughly reviewed by the client. HSPORTWEAR is not responsible after authorization for errors inadvertent by the client.

        In the event of a claim, evidence will be sent to HSPORTWEAR for verification. These evidences must be sent within three days, marking the errors to facilitate review by HSPORTWEAR.

        HSPORTWEAR does not grant the customer any legal guarantees. Manufacturer guarantees are not modified.

        REPAIR SERVICE

        HSPORTWEAR offers a free repair service in case of factory defects.

        Return an item for repair:

        • Please wash the garment and make sure it is completely dry before packing it. Otherwise, it will be returned unrepaired.
        • Once we receive your item, it will usually be processed within a week and a confirmation email will be sent to you. If you do not hear from us within this time, please email us at info@hsportwear.com with full shipping details.

        Note: We may cancel repairs if the damage is irreparable (e.g. stains, abrasions, scissor cuts or excessive damage) but an alternative solution will be offered where possible.

        This repair service will be offered within the legal period established by current regulations, which may vary depending on the jurisdiction.

        RESPONSIBILITIES

        HSPORTWEAR excludes liability to the customer for slight negligence, provided that this does not affect essential contractual obligations, damages resulting from injury to life, body or health or guarantees arising under the Product Liability Act. The same applies to infringements by agents or legal representatives of HSPORTWEAR. An essential contractual obligation occurs in obligations whose fulfillment allows the proper execution of the contract or in which the customer can and must rely on their fulfillment.

        HSPORTWEAR's liability to an entrepreneur for slight negligence in breach of an essential contractual obligation is limited to foreseeable and typical damages.

        Access to and use of this website is the responsibility of the users. HSPORTWEAR does not guarantee:

        • The infallibility, availability, continuity, and absence of security deficiencies on the website.
        • That the content of the page or the information that passes through it is free of viruses or other harmful elements, as well as errors, omissions or inaccuracies.
        • Any possible damages or losses that may arise from interference, omissions, interruptions, computer viruses, breakdowns or disconnections in the operational functioning of the website.
        • Delays or blockages in the use of this page caused by deficiencies or overloads of the data processing center, or damages that may be caused by third parties through illegitimate interference that is beyond the control of HSPORTWEAR.

        Mere access to the website does not imply establishing any type of commercial relationship between HSPORTWEAR and the user.

        HSPORTWEAR only supplies the products for personal use. The customer agrees not to use the product for commercial, advertising or resale purposes. HSPORTWEAR has no liability for any loss of profit, loss of business, business interruption or loss of business opportunity of the customer.

        ASSIGNMENT OF RIGHTS AND OBLIGATIONS

        The contract is binding on both the customer and HSPORTWEAR as well as on our respective successors, assignees and legal representatives. The customer may not transfer, assign, encumber or otherwise transfer a contract or any of the rights or obligations arising from it, without having obtained the prior written consent of HSPORTWEAR.

        We may transfer, assign, charge, subcontract or otherwise transfer a contract, or any of our rights or obligations under it, at any time during its term. For the avoidance of doubt, such transfer, assignment, charge or other transfer shall not affect any statutory rights you may have as a consumer nor shall it void, reduce or otherwise limit any express or implied warranties we may have given you .

        INFORMATION AND CONTENTS OF THE WEBSITE

        The information displayed on the website is current as of the date of last update.

        HSPORTWEAR reserves the right to update/modify/delete information from this website at any time and without prior notice.

        In the event that the website contains links to other websites and materials from third parties, these links are provided for information purposes only, and HSPORTWEAR has no control over the content of such websites or materials.         HSPORTWEAR reserves the right to modify the Terms and Conditions of Purchase. The modifications introduced will not be retroactive. If you do not agree with the modifications introduced, we recommend that you do not use our website.

        VIRUS, PIRACY AND OTHER COMPUTER ATTACKS

        You must not misuse this website by knowingly introducing viruses, trojans, worms, logic bombs or any other technologically harmful or damaging programs or material. The customer shall be solely liable for any infringement of copyright, sample rights, personality rights or name rights. The customer also assures that he will not infringe the rights of third parties by individualising the product.

        Mainly, in the case of using logos, images, slogans, fonts or legally protected designs, the client is responsible for obtaining written authorization from the legal owner and submitting it to HSPORTWEAR without being requested.

        The customer shall release HSPORTWEAR from all claims and rights asserted by the violation of such third party rights, provided that the customer is responsible for the breach of duty. The customer shall bear all costs of defense and other damages incurred by HSPORTWEAR.

        Designs containing images or inscriptions or other customer wishes that affect the privacy rights of third parties, contain pornography, are intended for the distribution of prohibited propaganda or incite the commission of crimes or participation in them, will not be produced by HSPORTWEAR.

        All products supplied by HSPORTWEAR generally contain

        • One or more HSPORTWEAR logos and/or texts visibly.
        • One or more visibly sewn-in HSPORTWEAR labels with a HSPORTWEAR logo and/or text.
        • One or more HSPORTWEAR labels sewn or sublimated on the inside, with a HSPORTWEAR logo and/or text.
        • A washing label with HSPORTWEAR logo and/or text.

        In addition, other materials of the textile product may bear the logo of HSPORTWEAR , such as non-slip rubber or zippers.

        HSPORTWEAR has the right to present its products on its website (online shop), in its catalogues (and online catalogues) as well as in other forms of product presentation, advertisements, etc. regardless of their form (electronic or written) and at exhibitions.

        HSPORTWEAR may mention the customer in various media as a reference. This also includes the mention and use of any of the protected names or logos. HSPORTWEAR shall not be obliged to mention the customer. The customer may restrict or prohibit being mentioned by HSPORTWEAR.

        In the event of a production error or overproduction, HSPORTWEAR reserves the right to use said products as samples available to other customers or to be used in internal controls.

        APPLICABLE LEGISLATION AND JURISDICTION

        The use of this website and contracts for the purchase of products through it shall be governed by Spanish law. Any dispute arising from or related to the use of the website or such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals.
